Contest Terms and Guidelines

By submitting a photograph(s) to the 2020 Catskill Center Photo Contest, you agree to the following:

1. You, the Participant, represent and warrant that: a) You are the sole and exclusive author and owner of the photograph(s) and all rights therein; b) You have the full and exclusive right, power, and authority to submit the photograph(s) and to grant the Catskill Center for Conservation and Development, Inc. (the Catskill Center) the rights granted herein, including a worldwide copyright license, upon the terms and conditions set herein; c) No rights to the photograph(s) have been previously granted to any person, firm, corporation or other entity, or otherwise encumbered such that the prior grant would limit or interfere with the rights granted to the Catskill Center herein; d) No part of your photograph(s) defames or invades the privacy or publicity rights of any person, living or decreased, or otherwise infringes upon any third party’s copyright, trademark or other personal or property rights.

2. You irrevocably grant the Catskill Center non-exclusive, worldwide, royalty-free, perpetual license to use the photograph(s) in any manner related to the organization, including all associated use, reproduction, distribution, sublicense, derivative works, and commercial and non-commercial exploitation rights in any and all media now known or hereafter invented.

3. You understand that participation in this contest is entirely voluntary.

4. You understand and agree with the following statements associated with Rules, Decisions, and Prizes:

   • You must abide by the contest rules.

   • The decisions of the contest judges are final.

   • All US federal, state, and local taxes and any other fees from receiving prizes are the sole responsibility of the prize winners.

   • If the winner(s) of any prize is found to be ineligible or decline the prize, the prize will be forfeited. The Catskill Center and the judges, at their sole discretion, may choose whether to award the prize to another contestant.

5. You understand there is no expectation of compensation for submitting photograph(s) or from the Catskill Center’s use of the photograph(s) for any purpose. The Catskill Center will only credit photographers of the winning photos and only when they are published as the contest winners in Catskills Magazine. All other photos submitted and published for all other purposes will not be credited to you, the original photographer, as the Catskill Center retains copyright of the photograph(s) once submitted.

6. All participants warrant that all co-creators agree with the terms of the contest. If there are co-creators of the submitted photograph(s), then Participant warrants that the co-creators have all given approval for submission of the photograph(s) to this contest and for its potential uses as described above.

7. If a photo in your submission contains recognizable faces of people other than you, you are required to obtain their permission prior to submission. You may be required to provide proof of these permissions in a form acceptable to the Catskill Center.

8. Photograph(s) content must be appropriate for all audiences.

9. There is no entry fee for entering the contest.

10. All decisions are final.
